User Agreement & Privacy Policy

Thank you for using PicSelf, an AI-powered photo editing and creative media application operated by WonderSky Technology Co., Limited ("we", "us", "our"). Through PicSelf, you can access AI tools including AI Image-to-Video, AI image editing, AI video generation, and other creative media features.

By downloading, installing, or using PicSelf, you agree to be bound by this User Agreement & Privacy Policy ("Agreement"), which governs both your use of our services and how we handle your personal information. If you do not agree, please do not use our services.

When using PicSelf, you must comply with all applicable laws and platform policies. You are prohibited from producing, uploading, or disseminating the following:

1. Illegal Content: Any content violating internationally recognized laws, regulations, or the local laws of any target market.
2. Infringing Content: Content that infringes on the intellectual property, privacy, portrait, or other legitimate rights of any individual or entity.
3. Harmful Content: Hate speech, incitement to violence, pornography, terrorism-related material, or content that demeans, harasses, or threatens individuals or groups.
4. System Abuse: Introducing viruses, malicious code, or programs designed to disrupt platform functionality; exploiting system or API vulnerabilities to obtain credits or subscription benefits unlawfully.
5. Reverse Engineering: Attempting to decompile, disassemble, or derive the source code of PicSelf's software or AI models.
6. Automated Abuse: Using scripts, bots, or automated tools to batch-call AI services or engage in bulk account registration.

AI-Generated Content Labeling: Where required by applicable law, PicSelf will automatically apply provenance labels or watermarks to AI-generated content. You shall not delete, obscure, or tamper with such labels without authorization.

All proprietary content, features, and functionalities of PicSelf — including text, graphics, logos, images, audio, data compilations, and software — are the exclusive property of PicSelf and WonderSky Technology Co., Limited, protected by international copyright laws. Without our prior written consent, you may not copy, distribute, modify, publicly display, or transmit any content from PicSelf.

"PicSelf" and all related names, logos, and slogans are trademarks of WonderSky Technology Co., Limited. You must not use these marks without our written permission.

Your Content & AI-Generated Outputs: Intellectual property rights associated with AI-generated outputs generally belong to you, within the limits permitted by applicable law. PicSelf uses user-submitted content only as necessary to provide, operate, maintain, secure, and improve the requested app functionality. PicSelf does not use user-uploaded photos, videos, text instructions, generated images, or generated videos to train AI models or for advertising tracking without the user's explicit consent.

Your Responsibility: You must ensure that all content you input (text, images, audio, video) is legal, compliant, and that you hold the legal right to use it or have obtained all necessary authorizations.

We collect personal information when you register, subscribe, contact us, or access certain features. The data we may collect includes:

We also collect non-personal information (aggregated usage statistics, device categories, session durations) to monitor service performance and prioritize improvements. This data does not identify individual users and may be shared in anonymized, aggregated form.

We use your personal information to: provide and improve services, process payments, communicate with you, and conduct statistical analysis. We do not sell your personal information. We may share data only in the following limited circumstances:

• Service Providers: With vendors, payment processors, and analytics providers bound by confidentiality obligations, who process data only on our behalf and for purposes we specify.
• Legal Requirements: In response to valid legal requests, court orders, or regulatory obligations.
• Safety: To protect the rights, property, and safety of PicSelf, our users, or others.
• Business Transactions: In connection with mergers, acquisitions, or restructurings, subject to continued protection of your data.
• With Your Consent: For any other purpose with your explicit prior consent.

Your data is stored primarily in the United States. For EEA and UK users, data transfers outside those regions are protected through Standard Contractual Clauses (SCCs) and other lawful transfer mechanisms. You may request a copy of applicable transfer safeguards by contacting us.

We protect your data through encryption in transit (TLS 1.2+), encryption of sensitive data at rest, secure server infrastructure, role-based access controls, and regular security assessments. In the event of a data breach affecting your rights, we will notify affected users and relevant authorities within 72 hours.

To exercise any right, email support@sendmail.picself.ai. You may also lodge a complaint with the data protection regulator in your region. We retain data only as long as necessary; when no longer needed, we securely delete or irreversibly anonymize it.

To ensure platform compliance and a positive user experience, PicSelf conducts automated content detection and review of user-submitted and generated content (text, images, videos). These review processes are operated or controlled by PicSelf for content compliance, security risk control, abuse prevention, and service quality assurance. PicSelf does not share user-uploaded photos, videos, text instructions, generated images, or generated videos with third-party AI service providers for AI generation, model training, or independent processing.

If content is determined to violate applicable laws, App Store policies, or this Agreement, PicSelf reserves the right to restrict generation, block or delete content, suspend functions, or terminate services without prior notice.

Users are fully responsible for the legality and compliance of all content they submit or generate. Any legal liabilities arising from published content shall be borne solely by the user.

Each breach of this Agreement constitutes a separate violation. Unless otherwise required by law, violations are generally handled according to the following tiers:

Appeals: If you believe a penalty was issued in error, submit a written appeal to support@sendmail.picself.ai within 7 working days of the penalty notification. PicSelf will review and respond within 15 working days. The penalty remains in effect during review. Where an account is permanently suspended, remaining credits, subscriptions, and entitlements lapse without refund.

Subscription details — including start date, expiration, and tier — can be viewed in the Member Center within your account settings.

After cancellation, your subscription remains active until the end of the paid period. No partial refunds for unused portions, except where required by consumer protection law. All refunds for purchases through the App Store are subject to Apple's refund policies via reportaproblem.apple.com.

PicSelf provides AI media tools for creative, entertainment, and lawful use only. We make no warranties of any kind about the completeness, accuracy, or suitability of our services. AI-generated content may not always be perfect, unique, or free from third-party IP claims. You are solely responsible for evaluating the legality and appropriateness of any AI-generated content for your purposes.

You are strictly prohibited from using PicSelf for illegal, infringing, or unethical activities, including generating pornographic, violent, hateful, defamatory, or otherwise unlawful content. Violations may result in immediate termination and civil, criminal, or regulatory liability.

To the maximum extent permitted by law, PicSelf and WonderSky Technology Co., Limited shall not be liable for any indirect, consequential, special, or punitive damages arising from your use of our services. Where liability cannot be excluded, our total aggregate liability shall not exceed the greater of (a) the amount you paid in the twelve months preceding the claim, or (b) USD $100.

Indemnity: You agree to indemnify and hold harmless PicSelf, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of PicSelf, your violation of this Agreement, or any content you generate or share, including claims related to misuse of AI visual creation features, non-consensual content, or IP infringement.

PicSelf is not directed to children under 16 years of age (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children below this age. If we discover that we have inadvertently collected such data, we will delete it immediately.

Parents or guardians who believe their child has provided personal information without appropriate consent should contact us at support@sendmail.picself.ai.

PicSelf may contain links to or integrations with external platforms and services not operated by us. These are provided for convenience only and do not constitute endorsement. Your use of any third-party service is governed by that service's own terms and privacy policies, not by this Agreement.

PicSelf has no control over and assumes no responsibility for the content, practices, or data handling of any third-party service. We encourage you to review third-party terms before connecting your PicSelf account or sharing content externally.

We welcome your feedback on PicSelf. By voluntarily submitting feedback, ideas, or suggestions, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, and exploit such feedback for any purpose, without obligation to compensate or credit you.

This Agreement shall be governed by applicable laws based on your location:

• Colorado, United States: For users residing in or accessing from Colorado, the laws of the State of Colorado shall govern.
• Asia-Pacific Region: For users in Asia-Pacific (including Japan, South Korea, Southeast Asia), the applicable local laws of their respective jurisdiction shall govern.
• EEA & United Kingdom: For users in the EEA or UK, applicable EEA member state or UK law shall govern, including consumer protection legislation.
• All Other Regions: The laws of the United Kingdom shall govern.

Any disputes not resolved amicably shall be submitted to the courts of competent jurisdiction in the applicable region. Nothing herein limits your rights under mandatory consumer protection laws in your country of residence.
