Thank you for using PicSelf, an AI-powered photo editing and creative media application operated by WonderSky Technology Co., Limited. Through PicSelf, you can access innovative AI tools including AI Image-to-Video, AI image editing, AI video generation, and other creative AI media features.

By downloading, installing, accessing, or using PicSelf, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

All proprietary content, features, and functionalities available on PicSelf — including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software — are the exclusive property of PicSelf and WonderSky Technology Co., Limited, protected by international copyright laws. All rights are expressly reserved.

Without our prior written consent, you may not copy, distribute, modify, publicly display, publicly perform, republish, download, store, or transmit any content from PicSelf.

Your Content & AI-Generated Outputs: For content you input into PicSelf, within the limits permitted by applicable law, intellectual property rights associated with AI-generated outputs generally belong to you. PicSelf uses user-submitted content only as necessary to provide the requested app functionality, maintain service security, prevent abuse, verify entitlements, and improve service reliability. PicSelf does not use user-uploaded photos, videos, text instructions, generated images, or generated videos to train AI models without the user's explicit consent.

License for User-Input Content: You grant PicSelf a limited, non-exclusive license to process user-submitted content solely as necessary to operate, provide, maintain, secure, and improve the requested app functionality, including generating, editing, displaying, saving, sharing, and deleting results at your direction. PicSelf does not use such content for advertising tracking or AI model training without your explicit consent.

"PicSelf", the PicSelf name, and all related product and service names, designs, and slogans are trademarks of PicSelf and WonderSky Technology Co., Limited or its affiliates or licensors. You must not use such marks without our prior written permission.

This includes refraining from using the "PicSelf" trademark or any confusingly similar marks in connection with any content, software, or service that is not offered or authorized by PicSelf. We will vigorously protect our trademarks and enforce our rights under applicable trademark and unfair competition laws in all relevant jurisdictions.

Nothing in these Terms grants you any right to use our trade names, trademarks, service marks, logos, domain names, or other distinctive brand features without express written permission.

When using PicSelf, you must comply with all applicable laws, regulations, and platform policies. You are prohibited from producing, uploading, publishing, or disseminating the following types of content, or engaging in the following behaviors:

1. Violation of Laws: Any content violating internationally recognized laws, regulations, or the local laws of any target market, including export control laws and sanctions regulations.
2. Rights Infringement: Content that infringes on the intellectual property rights, privacy rights, portrait rights, or other legitimate rights or interests of any individual, entity, or the public.
3. Harmful Content: Hate speech, incitement to violence, pornography, terrorism-related material, or any content that demeans, harasses, or threatens individuals or groups.
4. Unauthorized Promotion: Promoting products, services, or commercial content without PicSelf's explicit prior consent or in violation of our content guidelines.
5. System Disruption: Introducing viruses, malicious code, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment associated with PicSelf.
6. Competing Products: Using the service, its outputs, or underlying technology to develop, train, or improve products or services that directly compete with PicSelf, without our express written consent.
7. Reverse Engineering: Obtaining content or data through improper means, or conducting reverse engineering, decompilation, disassembly, or any attempt to derive the source code of PicSelf's software or AI models.
8. Other Prohibited Content: Any other content or activity expressly prohibited by applicable laws, regulations, or platform guidelines issued by PicSelf from time to time.

Content Moderation: PicSelf reserves the right to use automated and human review processes to inspect user input content and generated results. Content that violates applicable regulations or infringes the legitimate rights of third parties may be deleted, blocked, or reported to relevant authorities as required by law.

AI-Generated Content Labeling: In accordance with applicable laws and regulations, PicSelf will automatically apply provenance labels or watermarks to AI-generated content where required. You shall not delete, obscure, or tamper with such labels without authorization.

If you breach these Terms, each instance shall be deemed a separate violation, and PicSelf reserves the right to take appropriate action. Unless otherwise required by applicable law or in cases of serious misconduct, violations are generally handled according to the following escalating tiers:

Additional Rules Regarding Account Suspension:

• (I) Basis for Determination: PicSelf makes comprehensive enforcement decisions based on system logs, AI-powered anomaly detection, PicSelf-operated or controlled security review processes, and user reports. We apply this process consistently and without discrimination.
• (II) Handling of Account Assets: Where an account is permanently suspended due to serious breach of these Terms, PicSelf reserves the right to terminate all associated services. Any remaining credits, points, subscription periods, or unexpired entitlements shall lapse upon suspension. Unless otherwise stipulated by mandatory law, PicSelf shall not provide any refund or compensation for suspended accounts.
• (III) Right of Appeal: If you believe a penalty decision was made in error, you may submit a written appeal to support@sendmail.picself.ai within 7 working days of receiving the penalty notification. Please include your account details and supporting evidence.
• (IV) Appeals Review Process: PicSelf will review submitted appeals and respond within 15 working days. The original penalty remains in effect during the review period. If an appeal is upheld, account functionality will be restored; however, PicSelf shall not be liable for additional compensation in respect of any service interruption during the suspension period.

You may subscribe to PicSelf premium services in accordance with the applicable subscription rules. All subscription details — including start date, expiration date, and subscription tier — can be viewed in the Member Center within your account settings.

Following cancellation, your subscription will remain active until the end of the paid billing period. After that date, your account will revert to the free tier and premium features, AI credits, and subscriber-exclusive content will no longer be accessible. No partial refunds are provided for the unused portion of the current billing period, except where required by applicable consumer protection law.

Refund Policy: All purchases made through Apple's App Store are subject to Apple's refund policies. To request a refund, please use Apple's standard refund request process via reportaproblem.apple.com or through the App Store. PicSelf does not have the ability to process refunds for purchases made through Apple directly.

Payment Security: All payments on iOS are processed by Apple.

PicSelf may offer optional integrations with or allow you to share content to external platforms and services not operated by us. Where such integrations exist, your use of those external services is governed entirely by their own terms of service and privacy policies, not by these Terms.

PicSelf is not responsible for the availability, accuracy, security, or compliance of any external service. We do not review, endorse, or guarantee the practices of any third-party platform. Before connecting your PicSelf account to any external service or sharing content externally, we encourage you to review the relevant third-party terms and understand any implications for your data.

Any data you share with or submit to an external platform through or in connection with PicSelf becomes subject to that platform's policies. PicSelf has no control over how third parties store, use, or protect information provided to them, and we expressly disclaim all responsibility for their data handling practices.

We actively welcome your feedback and are committed to continuously improving PicSelf. You are encouraged to share comments, suggestions, bug reports, or feature ideas through the contact channels provided in our app or website.

Your feedback helps us build a better product and directly informs our development roadmap. We review all submitted feedback, though we may not be able to respond individually to every submission.

By accessing PicSelf and using our services, you agree to indemnify, defend, and hold harmless PicSelf, WonderSky Technology Co., Limited, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

1. Your use of PicSelf and our services, including your reliance on any AI-generated output
2. Your violation of any provision of these Terms & Conditions
3. Your violation of any applicable laws, rules, or regulations
4. Any content you generate, create, upload, or share using PicSelf's services
5. Your infringement of any intellectual property rights, portrait rights, privacy rights, or other rights of any third party
6. 
   Your misuse of AI visual creation features, including any claims related to infringement, non-consensual content, defamation, fraud, or other unlawful use

This indemnification obligation survives the termination or expiration of these Terms and your cessation of use of PicSelf.

PicSelf provides its AI media tools — including AI image, video, photo, and creative media services — for creative, entertainment, and lawful personal or commercial use only. We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of our services for any particular purpose.

AI-Generated Content Disclaimer: AI-generated content is produced using complex machine learning models. While we strive for high quality, outputs may not always be perfect, unique, factually accurate, or suitable for every intended use. PicSelf does not warrant that AI-generated content will be error-free, meet your specific requirements, or be free from third-party intellectual property claims. You bear sole responsibility for evaluating the appropriateness, accuracy, and legality of using any AI-generated content for your purposes.

No Professional Advice: Nothing on PicSelf constitutes legal, financial, medical, psychological, or other professional advice. All information and AI-generated content is provided for general informational and creative purposes only. Please consult a qualified professional for advice tailored to your specific circumstances.

Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall PicSelf or WonderSky Technology Co., Limited be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages, or for any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising from or related to:

• Your use of or inability to use PicSelf or our services
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of service transmission
• Any bugs, viruses, trojan horses, or similar harmful code transmitted to or through our services by any third party
• Any errors, inaccuracies, or omissions in any content or AI-generated outputs
• Any loss or damage incurred as a result of your reliance on or use of any content available through PicSelf

Where liability cannot be excluded by law, our total aggregate liability shall not exceed the greater of (a) the amount you paid to PicSelf in the twelve months preceding the claim, or (b) USD $100. All rights not expressly granted herein are reserved to and retained by PicSelf.

If you believe your rights have been violated, if you encounter content that you consider illegal or inappropriate, or if you wish to appeal a platform enforcement decision, you may contact PicSelf through the following channels:

These Terms shall be governed by and construed in accordance with applicable laws based on your location of residence or the jurisdiction from which you access the services:

Any disputes arising from or relating to these Terms that cannot be resolved amicably shall be submitted to the courts of competent jurisdiction in the applicable region identified above. Nothing in this section limits your rights under mandatory consumer protection laws applicable in your country of residence.
